DIVERSI SEBAGAI BENTUK PENYELESAIAN PERKARA PIDANA ANAK MELALUI PENDEKATAN RESTORATIVE JUSTICE OLEH PENYIDIK

Abstract

The material for this research is how are the provisions and application of restorative justice to children as perpetrators in the juvenile justice system? Then, is the concept of Restorative Justice in the juvenile justice system in accordance with the perspective of Legal Benefits? And what is the ideal concept of legal protection for children who are in conflict with the law? This thesis research uses Normative and Empirical Legal Research, namely research that combines the approaches of literature and field research. From the results of the study it was found that the application of restorative justice to children as perpetrators of acts in the juvenile justice system had been carried out, but mostly it was carried out at the Prosecutor's Office instead of the Police. The concept of Restorative Justice in the juvenile justice system is in accordance with the perspective of Legal Benefits. The ideal concept of legal protection for children who are in conflict with the law is to prioritize the best interests of the child.
