PELINDUNGAN HUKUM BAGI PERSONEL BASARNAS DALAM MELAKSANAKAN OPERASI PENCARIAN DAN PERTOLONGAN (SAR)
Abstract
BASARNAS personnel, as the front line in handling disasters and transportation accidents in Indonesia, often face legal risks when carrying out rescue duties. The lack of specific and comprehensive legal protection for them creates vulnerability, especially in cases of operational failure that lead to lawsuits from the public. This study aims to analyze the existing forms of legal protection, identify weaknesses in the current legal system, and formulate recommendations to build a fair and comprehensive protection framework. Using a qualitative research method with a normative-empirical approach, data was collected through document studies, interviews, and analysis of legislation. The results of the study indicate that to date, there is no specific regulation governing legal protection for BASARNAS personnel in the field, thus creating legal uncertainty. Internal efforts that have been made, such as the development of SOPs and the formation of a legal assistance team, are deemed insufficient. This study recommends the establishment of specific regulations that guarantee limited immunity, strong legal support, and a risk-based compensation scheme to protect personnel on duty in emergency situations.
