TINJAUAN YURIDIS POLITIK HUKUM PERBURUHAN DALAM PELAKSANAAN HUBUNGAN KERJA NON STANDAR (NONSTANDARD EMPLOYMENT) BERDASARKAN PERATURAN KETENAGAKERJAAN DI INDONESIA
Abstract
This research examines Indonesia's labor law policy in the context of non-standard employment, which is increasingly prevalent with the growth of the digital economy (gig economy). The main issue studied is the weak legal protection for non-standard workers, such as regulatory ambiguity, vulnerability to exploitation, and the weak bargaining position of workers amid a labor market dynamic dominated by flexibility and capital interests. This study aims to analyze the direction of labor law policy related to non-standard employment and the determining factors that influence it. Using normative juridical research methods enriched with a socio-legal research approach, this study combines analysis of labor regulations with social, economic, and political contexts. The results show that Indonesia's labor law policy in regulating non-standard employment is largely driven by labor market factors and investment interests, tending to accommodate flexible work arrangements while neglecting job security, social guarantees, and fair wages. The government is considered not yet optimal in providing comprehensive legal protection and strict enforcement. Therefore, this research recommends the need for clear and comprehensive regulations, fair wage standards, and the strategic role of trade unions in advocating for the protection of non-standard workers' rights through the formulation of new labor legislation
