TINJAUAN HUKUM FUNGSI PERJANJIAN KERJA BERSAMA DALAM MEMINIMALISASI PERSELISIHAN HUBUNGAN INDUSTRIAL DI PT PEGADAIAN
Abstract
Large companies such as PT Pegadaian face complexities in managing industrial relations as they are governed not only by labor regulations but also by a Collective Labor Agreement (CLA) mutually agreed upon between the company and the workers' union. This study aims to: (1) identify and analyze the formulation process and the content regulated in the CLA at PT Pegadaian; (2) analyze the implementation of industrial relations principles within the CLA; and (3) analyze preventive measures and the dispute resolution process for Industrial Relations Disputes (IRD) at PT Pegadaian. This research employs a descriptive-analytical qualitative method with a normative-empirical approach, linking legal regulations with relevant legal theories. The results indicate that the CLA formulation process at PT Pegadaian is conducted comprehensively, covering general industrial relations policies, preventive measures against disputes, and IRD resolution mechanisms. The CLA is designed to foster harmonious industrial relations, workplace peace, and enhanced employee productivity, thereby supporting PT Pegadaian's role as a corporation contributing added value to Indonesia's economy.
