ANALISIS YURIDIS UPAYA PERLINDUNGAN HUKUM TERHADAP GURU DALAM MENJALANKAN TUGAS PROFESINYA DI SEKOLAH
Abstract
This research is motivated by the phenomenon of teachers facing legal issues due to disciplinary actions against students, which raises concerns in carrying out their professional duties. Legal protection for teachers is an urgent issue that needs to be examined in greater depth. This study aims to analyze three main aspects: (1) the efforts of the school community in building understanding regarding guidance and discipline of students; (2) regulations and the implementation of legal protection for teachers; and (3) the role of professional organizations and law enforcement agencies through memorandums of understanding as well as government efforts in providing legal protection. The research employs a qualitative method with a normative empirical approach. The results indicate that schools have made efforts to build understanding through codes of ethics, socialization, and collaboration with parents, but teachers' legal awareness remains limited. Regulations such as the Teacher and Lecturer Law and the Minister of Education and Culture Regulations are in place, but their implementation is not yet optimal. Professional organizations and law enforcement have established memorandums of understanding, while government efforts are still uneven. This research is expected to contribute to the development of more systematic and fair legal protection policies for teachers.
