ANALISIS YURIDIS TINDAK PIDANA PENGANIAYAAN TERHADAP KORBAN PENGGEREBEKAN DAN PENGARAKAN

Abstract

Crime is an act or series of human actions that are contrary to the law. Persecution is an act of intentionally causing pain or injury to another person. Acts of persecution occur related to various factors. The problem in the research is what factors are behind the occurrence of criminal acts of persecution against victims of raids and parading and how are the judges' considerations in deciding whether the case has fulfilled the deterrent effect. The type of research is normative juridical, the nature of descriptive research. The qualitatively analyzed analysis concludes that it can be justified. As for the conclusion that acts of persecution are crimes that often occur, the factors behind emotional factors, state factors and environmental factors. And the witness testimony factor, the letter factor, the defendant's statement factor. The judge decided the defendant Article 351 paragraph 1 of the Criminal Code with a prison sentence of 1 year 6 months the judge's decision was not appropriate, did not meet the elements of justice and did not cause a deterrent effect.
