ANALISIS YURIDIS TERHADAP MAHASISWA YANG MENGONSUMSI NARKOTIKA GOLONGAN I DI TANGERANG

Abstract

Indonesia is a state of law, but in reality there are still many people who commit acts against the law which are narcotics crimes.  Problems: 1. How is the application of the law to perpetrators of criminal acts using narcotics class I? The method used is a normative juridical reviewing legislation and using secondary data, namely primary, secondary, and tertiary legal materials. The application of law against class I narcotics users, the defendant does not get rehabilitation rights, is not in accordance with the rule of law and SEMA number 4 of 2010 has not reached  justice. Judges in deciding class I narcotics users are sentenced to imprisonment not in accordance with existing laws and regulations.
