Abstract

The public as connoisseurs of health services should be given maximum service according to the procedures approved by the government in Law No. 36 of 2009 concerning Health. The formulation of the problem from the research is to find out how the criminal liability of malpractice is carried out by beauty clinics that do not yet have a permit and judge's considerations in making decisions about malpractice in decision number 51/Pid. Sus/2019/PN. krg. The purpose of this research is to answer all the problems in this research. as for the method used is library research with descriptive analysis, so that primary data and secondary data are analyzed qualitatively in order to obtain answers that can be scientifically justified. The conclusion that those who are not medical personnel and only claim to be medical personnel practice without a license and use drugs or cosmetics without a distribution permit and cause malpractice is that if it is a criminal act, it must go through legal procedures, namely the results of investigations and investigations where the action is criminal act.
