ANALISIS YURIDIS TINDAK PIDANA PENGGELAPAN TERHADAP ASET PERUSAHAAN YANG MERUGIKAN HAK PARA KARYAWAN

Abstract

The state has various types of crimes, for example the crime of embezzlement, the main factor in the occurrence of the crime of embezzlement itself cannot be separated from the background of a person who can commit the crime. The problem in this study is how to apply the law to cases of embezzlement with criminal cases Number 997K/Pid/2018, and how judges consider and impose penalties on cases of criminal acts of embezzlement. This research is a type of normative juridical research, while the theoretical basis refers to Article 372 of the Criminal Code which regulates the crime of embezzlement. The results of the study concluded that the application of the law in this case was in accordance with the legal provisions contained in article 372 of the Criminal Code because the elements of a criminal act had been fulfilled, in the facts of the trial, things were found that were abolishing and reducing liability. criminal acts in the form of mitigating matters, namely that he has never been punished, this is what affects the sanctions decided by the court.
