Abstract

The government made Law No. 11 of 2012 aimed at protecting and continuing to provide rights to services, care, education, and training, guidance and assistance in accordance with the laws and regulations that must be obtained by children in conflict with the law. In addition, this Law also regulates the Special Child Development Institution which aims to prove that the making of Law No. 11 of 2012 concerning the Criminal Justice System for Children has effectiveness in changing and improving the behavior and character of children who are in conflict with the law. The problem in this research is how the rights of fostered children are in the legislation no. 11 of 2012 concerning the juvenile criminal justice system and how is the effectiveness of the law no. 11 of 2012 concerning the criminal justice system of children in grade 1 fostered children in Tangerang. The research method used is empirical juridical by conducting interviews, field observations, and documentation as the main data sources. The results of this study are the rights of children in conflict with the law are regulated in Law No. 11 of 2012 concerning the juvenile criminal justice system in which services, care, education, and training, guidance and assistance must be obtained by children in conflict with the law. This right is protected and implemented by LPKA Class I Tangerang in order to fulfill the effectiveness of Law No. 11 of 2012 concerning the juvenile criminal justice system in fostering the behavior of fostered children and providing knowledge to be able to reconnect with the community.
