TINJAUAN YURIDIS PELAKSANAAN TRANSAKSI JUAL BELI ONLINE (E-COMMERCE) MELALUI SHOPEE PAYLATER BERDASARKAN PERSPEKTIF HUKUM POSITIF INDONESIA

Abstract

The development of technological systems has an impact on social change leading to the creation of a modern society. With this development, many people have taken advantage of technological sophistication because it can make it easier for humans to carry out all their activities. One thing that has been noticed by the development of the current technological system is the implementation of buying and selling online through Shopee Paylater with the system used in this transaction getting easier.The problem of this research is, what is the mechanism for using and buying and selling online transaction agreements through Shopee Paylater based on Indonesian positive law and how the application of the law applies to consumers who make late Shopee Paylater payments. This type of research is normative-empirical. The nature of the research used in the making of this thesis is descriptive analysis. Data analysis in this research is qualitative. The theoretical framework in this research is the Theory of Legal Protection, Theory of Legal Certainty, and Theory of Convenience.The current positive legal regulations in Indonesia against Shopee Paylater users who make late payments have been effective in ensnaring and overcoming these problems, although there is no specific law that regulates Shopee Paylater users who are late in making Shopee Paylater payments explicitly and clearly in this problem.
