Abstract

Default is the implementation of obligations that are not fulfilled or broken promises or negligence in carrying out achievements carried out by one party either because they do not carry out what has been agreed or even do something that according to the agreement must not be done. The default results in material or immaterial losses for the aggrieved party. Like the case of a cooperation contract in an agreement to manufacture garment articles which resulted in a breach of contract, where the main issue that will be examined is how to resolve the breach of contract in a cooperation contract in an agreement to manufacture garment articles and what are the legal consequences for the case of default based on Tangerang district court decision number: 951/ Pdt.G/2018/PN.Tng.
