ANALISIS YURIDIS TINDAK PIDANA UJARAN KEBENCIAN (HATE SPEECH) DALAM MEDIA

Abstrak

The development of social media in society continues to grow along with the rapid advancement of technology in Indonesia, excessive use of social media often makes someone to commit crimes on social media, one of which is hate speech, many Indonesian people cannot distinguish between expressing their opinions and hate speech, The problem in this research is how is the settlement process in the case of hate speech crimes on social media and what is the judge's consideration in imposing a sentence. This research method is a normative juridical research, which is descriptive in nature. According to the author, the judge in making a decision and imposing a sentence on the defendant is not in accordance with what the defendant has done. suggestions for the panel of judges to consider the reasons for the criminal aggravation for the Defendant.
