Abstract

Humans are required to work in order to fulfill their daily needs. The problem that is often heard at work is the problem of termination of employment. Therefore, termination of employment has become a very feared problem for workers, which has both psychological and economic impacts on workers. Termination of Employment Relations is regulated in Articles 150 to Article 172 of Law Number 13 of 2003 concerning Employment, including the reasons for Termination of Employment Relations. Termination of employment for reasons of efficiency as intended in Article 164 paragraph (3) of Law Number 13 of 2003 concerning employment. The problem that is attempted to be studied in this research is how the judge applies sanctions in the decision in case Number 184/Pdt.Sus-PHI/2019/PN Mdn and the judge's consideration of unilateral termination of employment for reasons of company efficiency in case Number 184/Pdt. Sus-PHI/2019/PN Mdn. The method used is the normative juridical type. The results of the research on the application of sanctions by the judge are the payment of the plaintiff's rights in the form of severance pay, long service awards and compensation money as regulated in Article 156 paragraph (2) of Law Number 13 of 2003 concerning Employment and the judge's legal considerations in deciding this case by considering the evidence, listening to witness statements and the plaintiff's application being accepted in part and rejected in part, the defendant must pay the plaintiff's salary shortfall in accordance with the Medan city minimum wage in 2018 and based on the Employment Law.
