Abstrak

The Head of the PUPR Service proposed to the mayor of Tangerang to recruit contract workers or freelance daily employees with the aim of improving the performance of the PUPR Service. However, in its implementation there are levies for returning salaries to Casual Daily Worker (TKHL) employees which are carried out by supervisors and coordinators in the Drainage maintenance sector in the East, West and Central regions using the method of falsifying work attendance and attendance data of Casual Daily Worker (TKHL) employees. BPJS membership cards since the beginning of work until now have not been issued or have not received BPJS membership cards. In fact, the salaries of casual TKHL workers are always deducted for BPJS payments of around IDR150,000 per person when receiving salary payments.The absence of a legal umbrella that regulates the existence of casual daily workers (TKHL) who work in Tangerang City Government Agencies, which causes there to be no certainty about their fate so that they receive less attention to their rights as workers who are employed for long periods of time continuously. continuously. Through qualitative research methods, it was found that the implementation of Casual Daily Labor (TKHL) at the PUPR Service was not running in accordance with Law no. 13 of 2003 concerning Man power. Therefore, it is hoped that regional governments can create a legal umbrella so that Casual Daily Workers (TKHL) receive legal certainty in their work, so that they receive legal protection against problems that arise in their employment relationship. They can also get their rights based on the Labor Law. It is best for Casual Daily Workers (TKHL) to be under the auspices of an outsourcing company as a third party engaged in labor procurement, so that the budget spent by the regional government to pay for workers' rights can be justified.
